Terms of Service

The short version
Don't operate DragDuro while driving. Have your co-driver run the app, or interact with it only when safely stopped. You are always responsible for driving legally and safely.
DragDuro is a reference tool, not the official word. Your event's rules, officials, and documents control what route you must drive and what counts as a completed checkpoint — not this app. We are not affiliated with any event, series, or sanctioning body.
The SOS feature is not an emergency service. If you have an emergency, call 911. SOS just flags you to other signed-in users; nobody is guaranteed to see it or respond.
Routes, pins, and fuel data can be wrong. Routes are made by people, E85 data comes from the U.S. DOE, and vendor pins come from applicants. Verify before you rely on any of it.
Track-to-track racing is dangerous. You assume the risks of motorsport and road travel. Our liability is strictly limited, and disputes go to individual arbitration.
That's the plain-English gist. The full terms below are what's binding.
1.Acceptance of these Terms
These Terms of Service ("Terms") are a legal agreement between you and TheDigicar LLC ("DragDuro," "we," "us," or "our") governing your access to and use of the DragDuro websites and web applications at dragduro.com — including the route viewer, route maker, E85 station map, print tools, accounts, map pins, promoter tools, and any related features, content, and services (collectively, the "Service").
BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
THESE TERMS INCLUDE AN ASSUMPTION-OF-RISK AND RELEASE PROVISION (SECTIONS 4 AND 19) AND REQUIRE BINDING INDIVIDUAL ARBITRATION OF DISPUTES AND WAIVER OF CLASS ACTIONS (SECTION 22). PLEASE READ THEM CAREFULLY.
You represent that you are at least eighteen (18) years of age (or the age of majority in your jurisdiction, whichever is greater), that you are legally able to enter into a binding contract, and that you are not barred from using the Service under any applicable law.
2.What DragDuro is (and is not)
DragDuro is a set of tools for track-to-track drag racing events. It displays prescribed routes between drag strips, shows mandatory photo checkpoints, snaps your reported position to a route line, plots publicly listed E85 fuel stations, and lets users create and print route documents.
DragDuro is not:
- A turn-by-turn navigation system. The Service shows a prescribed line and checkpoints; it does not give real-time driving guidance, does not account for road closures, construction, traffic, weather, or hazards, and must never be treated as a substitute for your own observation and judgment.
- An official event system. Checkpoint auto-check indicators, route lines, distances, and progress shown in the Service are informational conveniences only and have no official standing at any event (see Section 5).
- An emergency or safety service. See Section 7.
- A tracking or verification service. The Service does not verify checkpoint compliance; proof of checkpoint completion is whatever your event requires (for example, your own social media post).
3.Driving safety
NEVER OPERATE, VIEW, OR INTERACT WITH THE SERVICE WHILE DRIVING. A driver's attention must remain on the road at all times. Interact with the Service only when your vehicle is safely stopped in a lawful location, or have a passenger or co-driver operate it.
You agree that at all times while using the Service you will:
- Comply with all applicable traffic laws, speed limits, and hands-free/distracted-driving laws in every jurisdiction you travel through;
- Rely on your own eyes and judgment — not the Service — for all driving decisions, including turns, lane position, road conditions, and hazards;
- Mount any device securely and lawfully, and configure it before departure;
- Not use the Service to facilitate racing, speed contests, or reckless driving on public roads. Competition timing belongs at the drag strip, on a sanctioned surface — not between checkpoints.
Position snapping, distance-to-turn readouts, and checkpoint proximity indicators depend on GPS and network conditions and may be inaccurate, delayed, or unavailable. Do not use the Service for any purpose requiring precise direction, distance, or location.
4.Assumption of risk — motorsport & road travel
YOU ACKNOWLEDGE THAT DRAG RACING, TRACK-TO-TRACK RACING EVENTS, AND LONG-DISTANCE ROAD TRAVEL IN MODIFIED OR HIGH-PERFORMANCE VEHICLES INVOLVE INHERENT AND SIGNIFICANT RISKS, INCLUDING VEHICLE FAILURE, COLLISION, FIRE, PROPERTY DAMAGE, SERIOUS BODILY INJURY, AND DEATH. THESE RISKS EXIST REGARDLESS OF ANY INFORMATION PROVIDED OR OMITTED BY THE SERVICE. YOU VOLUNTARILY ASSUME ALL SUCH RISKS, WHETHER OR NOT FORESEEABLE, ARISING FROM OR RELATED TO YOUR PARTICIPATION IN ANY EVENT OR YOUR USE OF OR RELIANCE ON THE SERVICE.
Nothing in the Service constitutes advice about the safety, legality, or suitability of any route, road, fuel, vehicle, or event. You are solely responsible for your vehicle's condition and legality, your preparation, your supplies, and your decisions.
5.No affiliation with events; event rules control
DragDuro is not affiliated with, sponsored by, or endorsed by any event, series, promoter (except where a promoter separately uses our promoter tools, as described in Section 10), or sanctioning body. Event names, route names, and related marks belong to their respective owners and are used for identification only.
The rules, officials, and published documents of the event you are attending are the sole authority on the required route, mandatory checkpoints, proof-of-completion requirements, penalties, and everything else about the competition. If the Service disagrees with your event's rules or officials, the event controls. An auto-checked checkpoint in the Service does not mean an event will credit that checkpoint, and an unchecked one does not mean you missed it. We are not responsible for disqualifications, penalties, scoring disputes, or any other competitive outcome.
6.Accounts, profiles & contact info
Most of the Service works without an account. If you create an account, you agree to provide accurate information and keep it current, and you are responsible for all activity under your account and for safeguarding your credentials. Notify us promptly of any unauthorized use.
Your display name may be visible to other users. If you add contact information (such as a phone number) to your profile, you understand and agree that it may be shown to other signed-in users of the Service — including, for example, when you report yourself as a racer in need (Section 7). Do not add contact information you are unwilling to share with other signed-in users.
You may need to leave any organizations you belong to within the Service before deleting your account. See Section 17 for deletion.
7.SOS / racer-in-need feature
THE SOS / RACER-IN-NEED FEATURE IS NOT AN EMERGENCY SERVICE AND IS NOT MONITORED. IT DOES NOT CONTACT 911, POLICE, FIRE, MEDICAL, OR ROADSIDE-ASSISTANCE SERVICES. IF YOU ARE EXPERIENCING AN EMERGENCY, CALL 911 (OR YOUR LOCAL EMERGENCY NUMBER) IMMEDIATELY.
The SOS feature simply lets a signed-in user flag themselves as needing help, making that flag — and, if provided, their contact info and approximate location — visible to other signed-in users. You acknowledge and agree that:
- No one — including us — is obligated to see, monitor, relay, or respond to any SOS flag, and we make no guarantee that anyone will;
- SOS flags depend on network connectivity, device function, and user action, and may fail to post, display, or update;
- Any assistance rendered between users is a private matter between those users. We do not vet responders and are not responsible for the acts or omissions of any user who responds (or fails to respond) to an SOS flag;
- You will not post false, misleading, or joke SOS flags. Doing so may result in immediate termination of your account.
8.Routes, checkpoints & user content
The Service allows users to create, upload, and share content, including GPX tracks, routes, checkpoint names and locations, geofence radii, display names, map pin applications, and other materials ("User Content").
Your responsibility
You — not DragDuro — are entirely responsible for User Content you submit. You represent and warrant that you have all rights needed to submit it and that it does not infringe any third party's rights, violate any law, or contain false or misleading information. Routes created with the route maker are made by people and may contain errors: wrong turns, roads that don't exist or aren't legal to drive, checkpoints in unsafe locations. Anyone using a route is responsible for verifying it against the official event documents and real-world conditions.
License to us
You retain ownership of your User Content. By submitting it, you grant TheDigicar LLC a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, adapt, publish, display, and distribute your User Content in connection with operating, providing, promoting, and improving the Service. Where a feature shares your User Content with other users (for example, a published route or a map pin), you grant those users a non-exclusive license to view and use it within the Service.
Moderation
We have no obligation to pre-screen User Content but reserve the right to review, refuse, edit, or remove any User Content at any time, at our sole discretion, with or without notice.
Checkpoint photos
Photo proof of checkpoints is posted by you to your own social media or wherever your event requires — not to the Service. Those posts are governed by the terms of the platform you post them on, and by your event's rules.
9.Map pins (vendors, sponsors, fuel & more)
Signed-in users may apply to have a pin (shop, sponsor, food, fuel, parts, or similar) shown on a route map. By submitting a pin application, you represent that the information is accurate, that you are authorized to submit it, and that the pinned business or offering is lawful. Pins are reviewed before appearing, but review is not an endorsement — we do not endorse, vet, or guarantee any pinned business, product, or service.
Your dealings with any vendor, sponsor, or other party you discover through the Service — including purchases, fuel, repairs, and services — are solely between you and that party. We are not liable for any loss or damage arising from those dealings. We may edit, decline, or remove any pin at any time at our sole discretion, and pins may become inaccurate (hours, locations, availability) without notice.
10.Event promoters
Promoters may request access to promoter tools to publish routes, brand the driver-facing experience, manage pins, post driver alerts, and view SOS flags. Promoter access may be subject to additional terms presented at or before the time access is granted; those additional terms control over these Terms in the event of a conflict, for promoter-specific matters.
If you use promoter tools, you additionally represent and agree that: (a) you have authority to act for the event you represent; (b) you are solely responsible for the accuracy, legality, and safety of the routes, checkpoints, alerts, branding, and other content you publish; (c) you have all rights necessary to the marks and materials you upload; and (d) the Service is a convenience layer for your participants, and you remain solely responsible for the conduct, rules, safety, and administration of your event. You will indemnify us for claims arising from your event or the content you publish, as set out in Section 20.
11.E85 stations, maps & other third-party data
E85 station data is sourced from the U.S. Department of Energy Alternative Fuels Data Center and other public sources. Station locations, availability, hours, and fuel quality change constantly and are not verified by us. A station shown on the map may be closed, out of E85, or mislabeled. Verify fuel availability before you depend on it — running out of fuel, or running the wrong fuel, is on you.
The Service also relies on third-party services, including base maps and hand-offs to Google Maps for navigation. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their accuracy, availability, or conduct. Links to external sites and resources are provided for convenience and are not endorsements.
12.Printed documents
The print tools generate checklists and direction documents from route data as paper backups. Printed documents inherit any errors in the underlying route data and become stale the moment conditions or the official route change. They are informational conveniences only, are not official event documents, and are subject to all the disclaimers in these Terms.
13.License to use the Service; our IP
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service, and to print a reasonable number of pages from the print tools, for your personal use in connection with attending, running, or following track-to-track racing events. Any other use — including commercial resale, redistribution of Service data, or offering the Service's functionality to others as your own — requires our prior written consent.
Except for User Content, the Service and all of its content, code, design, compilation, and other materials are owned by TheDigicar LLC or its licensors and are protected by intellectual-property laws. "DragDuro," the DD mark, and "Compete. Drive. Compete." are marks of TheDigicar LLC. All rights not expressly granted are reserved. You may not copy, modify, create derivative works from, reverse engineer, scrape, frame, or redistribute the Service or any part of it except as expressly permitted by these Terms or applicable law.
14.Acceptable use
In connection with the Service, you will not:
- Violate any applicable law, or use the Service to plan, encourage, or commit illegal street racing, trespass, or any other unlawful act;
- Submit content that is illegal, infringing, defamatory, harassing, deceptive, or that you know to be false — including false SOS flags, fake pins, and deliberately misleading routes or checkpoints;
- Impersonate any person or entity, or misrepresent your affiliation with any event, promoter, or sanctioning body;
- Harvest, scrape, or misuse other users' contact information, including contact info made visible through the SOS feature, for any purpose other than its intended one;
- Interfere with or disrupt the Service, probe or breach its security, impose unreasonable load on its infrastructure, or access it with bots, scrapers, or automated tools;
- Upload viruses or malicious code, or attempt to gain unauthorized access to accounts, systems, or data;
- Sell, share, or transfer your account, or use the Service to build or support a competing product.
15.Feedback
If you send us suggestions, ideas, or other feedback about the Service, we may use it freely, in any form and for any purpose, without restriction, credit, or compensation to you.
16.Changes to the Service or these Terms
We may modify, suspend, or discontinue the Service or any part of it at any time, with or without notice, and we will not be liable to you or any third party for doing so. We may also update these Terms from time to time. The current version will always be posted on this page with its effective date; for material changes we will provide notice by reasonable means, such as a notice within the Service. Your continued use of the Service after updated Terms take effect constitutes acceptance. If you do not agree to the updated Terms, stop using the Service.
17.Termination & account deletion
You may stop using the Service at any time and may delete your account through the account page, which removes your profile, contact info, pins, and any active SOS flag (you may first need to leave any organizations you belong to). Some content may persist in backups for a limited period, and content you shared publicly (such as published routes) may remain in the Service.
We may suspend or terminate your access to the Service, or remove your User Content, at any time, with or without notice, if we believe you have violated these Terms or if we reasonably deem it necessary to protect the Service or its users. Upon termination, the rights granted to you under these Terms end immediately; sections that by their nature should survive (including Sections 4, 8 (license), 13, 15, and 18–24) survive termination.
18.Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT AND DATA WITHIN IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THEDIGICAR LLC EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT POSITION, ROUTE, CHECKPOINT, PIN, OR FUEL-STATION DATA WILL BE ACCURATE, CURRENT, OR COMPLETE; OR THAT ANY DEFECT WILL BE CORRECTED. ALL INFORMATION IN THE SERVICE IS PROVIDED FOR GENERAL INFORMATIONAL PURPOSES ONLY. YOU ARE SOLELY RESPONSIBLE FOR CONFIRMING ALL INFORMATION AND CONDITIONS — INCLUDING ROUTES, ROADS, CHECKPOINTS, FUEL, AND WEATHER — BEFORE TAKING OR OMITTING ANY ACTION.
19.Release; limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU VOLUNTARILY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS THEDIGICAR LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND LICENSORS (THE "DRAGDURO PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, AND CAUSES OF ACTION FOR PROPERTY DAMAGE, BODILY INJURY, WRONGFUL DEATH, OR OTHER LOSS ARISING FROM OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, YOUR RELIANCE ON ANY INFORMATION IN IT, YOUR PARTICIPATION IN ANY EVENT, OR THE ACTS OR OMISSIONS OF ANY OTHER USER, INCLUDING IN CONNECTION WITH THE SOS FEATURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DRAGDURO PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR ANY LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE DRAGDURO PARTIES' TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50) OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.
The limitations in this section do not apply to liability that cannot be limited under applicable law, including liability arising from our gross negligence or willful misconduct. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.
20.Indemnification
You will indemnify, defend, and hold harmless the DragDuro Parties from and against any claims, demands, losses, damages, costs, liabilities, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your access to or use of the Service; (b) your User Content, including routes, pins, and promoter-published content; (c) your violation of these Terms or any law; (d) your violation of any third party's rights; (e) your participation in, or (if you are a promoter) your operation of, any event; or (f) your driving or operation of any vehicle.
21.Governing law
These Terms are governed by the United States Federal Arbitration Act, applicable federal law, and the laws of the State of Florida, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
22.Arbitration & class action waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.
(a) Agreement to arbitrate. You and TheDigicar LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or your access to or use of the Service (each, a "Claim") shall be resolved by binding arbitration on an individual basis, rather than in court — except that (i) either party may bring an individual claim in small claims court if it qualifies, and (ii) either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual-property rights.
(b) Procedure. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org, before a single neutral arbitrator, conducted in English. Payment of filing, administration, and arbitrator fees will be governed by the AAA's rules. Arbitration may be conducted by videoconference or, if in person, in the county where you reside (or another mutually agreed location). The arbitrator's decision is final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
(c) Class action waiver. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN ARBITRATION, EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL, AND SUCH CLAIM SHALL BE BROUGHT EXCLUSIVELY IN THE STATE OR FEDERAL COURTS LOCATED IN ORANGE COUNTY, FLORIDA, AND YOU CONSENT TO THEIR JURISDICTION AND VENUE.
(d) Opt-out. You may opt out of this arbitration agreement by emailing dragduroapp@gmail.com within thirty (30) days of first accepting these Terms, with the subject line "Arbitration Opt-Out" and your name and account email. Opting out of arbitration does not affect any other part of these Terms.
(e) Severability. If the class action waiver is found unenforceable as to a particular Claim, then the arbitration agreement shall not apply to that Claim, which shall proceed in the courts identified in subsection (c); all other Claims remain subject to arbitration.
23.Copyright complaints (DMCA)
If you believe content in the Service infringes your copyright, send a notice to dragduroapp@gmail.com with the subject "DMCA Notice," including: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and where it appears in the Service; (d) your contact information; (e) a statement of your good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf. We may remove allegedly infringing content and may terminate repeat infringers' accounts.
24.General provisions
These Terms (together with any additional terms presented for specific features, such as promoter tools, and our Privacy Policy) constitute the entire agreement between you and TheDigicar LLC regarding the Service, and supersede all prior agreements on that subject. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, sale of assets, or by operation of law. Our failure to enforce any provision is not a waiver. If any provision is held invalid or unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. We are not liable for any failure or delay caused by events beyond our reasonable control. There are no third-party beneficiaries to these Terms except the DragDuro Parties as expressly provided.
